UK ethnicity & disability pay gap:
What It Means - and How to Stay Compliant
The UK government is preparing to introduce mandatory reporting of ethnicity and disability pay gaps under the upcoming Equality (Race and Disability) Bill. With legislation expected as early as 2026, forward-thinking employers are preparing now to avoid last-minute stress, protect their reputation, and lead on equity.
What Is UK Ethnicity & Disability Pay Gap Reporting?
Following the Gender Pay Gap reporting framework, the UK government is expected to require large employers (250+ employees) to publicly report on both ethnicity and disability pay gaps. The Equality (Race and Disability) Bill, currently under consultation, is likely to pass in late 2025 or early 2026.

Why Early Compliance Matters
Why You Need to Start Now — Not When It’s Mandatory
If you wait until legislation is enacted, you may face:
Future regulation may include monetary penalties for late, incomplete, or non-submission — in line with other pay gap enforcement policies.
Most companies don’t yet collect ethnicity and disability data comprehensively. Rushing at the last minute means unreliable reports and compliance risk.
The expectation of transparency is already here. Being behind the curve risks media scrutiny, public distrust, and losing credibility with customers or talent.
Employees care deeply about fairness. Publishing unverified or unaddressed pay gaps can damage internal trust, especially in underrepresented groups.
Who Will Likely Need to Comply?
Key Deadlines & Times
The UK government is currently consulting on the Equality (Race and Disability) Bill, which proposes mandatory pay gap reporting for large employers (those with 250 or more employees). While the legislation is not yet in force, here are the important dates to be aware of:
Consultation Period: The consultation is open until 11:59pm on 10 June 2025. Employers and stakeholders are encouraged to provide feedback during this period.
Legislation Enactment: Following the consultation, the government aims to introduce the legislation later in 2025.
First Reporting Cycle: If the legislation is enacted in 2025, the first reporting cycle could commence as early as April 2026, aligning with the existing gender pay gap reporting schedule.
It’s important to note that these dates are subject to change based on the outcomes of the consultation and the legislative process.
Average and midpoint pay comparisons between ethnic groups and between disabled and non-disabled employees.
Disparities in bonus pay awarded — by both ethnicity and disability status.
How different groups are distributed across the lowest to highest salary bands.
The percentage of each demographic group receiving any form of performance-related pay.
Total workforce split by disclosed ethnicity and disability status.
How many employees chose not to disclose — crucial for building trust and measuring accuracy.
Provide the story behind your numbers — context, justification, and any steps being taken to close gaps.
Many frameworks encourage or require an outline of actions you’re taking to reduce disparities and promote pay equity over time.
